Form I-9 Employment Eligibility Verification is a federal requirement for all U.S. employers. Failing to properly complete and retain I-9 forms can result in significant fines and penalties.

What Is Form I-9?

Form I-9 is used to verify the identity and employment authorization of individuals hired for employment in the United States. Both employees and employers must complete sections of the form.

Who Must Complete Form I-9?

All U.S. employers must complete an I-9 for every employee hired after November 6, 1986, regardless of citizenship or immigration status.

The Three-Day Rule

Employers must complete Section 2 of Form I-9 within 3 business days of the employee's first day of work.

Acceptable Documents

List A (establishes both identity and work authorization):

  • U.S. Passport
  • Permanent Resident Card
  • Employment Authorization Document
  • List B (identity only) + List C (work authorization):

  • Driver's license + Social Security card
  • State ID + birth certificate
